1. General

A deposit must be submitted to Zambata.com in advance of initial advertising date. By submitting advertising for inclusion on Zambata.com, advertiser/agency agrees to be bound by the terms of this contract. No conditions other than those set forth herein shall be binding on Zambata.com. This contract supersedes any previous agreements between Zambata.com and advertiser/agency relating to the subject matter set forth herein. Zambata.com only obligation to serve advertisements hereunder shall be to serve advertisements of the advertiser described herein, and in no event shall Zambata.com be obligated to serve advertisements for any other advertiser

2. Right To Terminate

Zambata.com reserves the right to terminate any account for any of the following:

• Any artificial means of generating traffic including, but not limited to:           

• Hit bots,

• Manual or Autosurf Traffic,

• Multiple clicking scripts,

• Traffic from an open proxy server,

• Targeting specific keywords,

• Hidden links,

• Incentivizing surfers in any way
  or any other similar activity will result in Will result in termination of said account, forfeiture of all monies owed and possible criminal prosecution.

• Affiliate must have all referring pages written entirely in English.

• All searches MUST originate from either our home page (with your referral ID), our portal page uploaded to your website or from one of our searchboxes located on your website. No other forms of searches are acceptable.

• All pages containing our searchbox or portal-page must be entirely written in english. 

• All affiliates personal information must be filled out completely to receive payment. If any affiliates personal information is false or is not filled out completely you can get banned or deleted!

• Publicly posting derogatory and/or slanderous statements about Zambata.com, or any of its subsidiaries or officers and will result in forfeiture of all monies owed and possible criminal prosecution.

• No one is allowed to have more then 1 (one) accounts at Zambata.com

• So called Paid-To-Click or Paid-To-Search banners are absolutely forbidden.

Non-compliance with these terms and conditions may result in the forfeiture of all monies owed and permanent locking of account. Any of the above terminations can be carried out without prior notice. Zambata.com shall have the right, in its sole discretion, to determine whether Click-throus are fraudulent or derived from improper use of the Search Box(es).

All decisions by Zambata.com are final.

3. Member Responsibility

Members from all over the world are welcome, except from China.

Members must be 18 years old (21 where applicable) or older to participate in the adult search affiliate program (our adult filter is always off).

All Users sent by you must come from a Web page.

Only one affiliate account is allowed per member.

NO incentivizing to search or targeted keyword searches are allowed.

We will only pay for clicks generated from United States, Canada, Australia, United Kingdom, Germany, France, Spain, Nederland.

4. Changes and Cancellations

Cancellations and changes can be made via the advertiser login. Zambata.com advertising specifications are accessible through the advertiser login. Zambata.com reserves the right to change any of its advertising specifications at any time.

5. Delivery, Frequency and Makegood

All figures relating to the number of advertisements served as determined by Zambata.com shall govern, regardless of whether advertiser/agency is using the services of a third party ad server. If Zambata.com fails to provide the guaranteed number of impressions, Zambata.com will make good on this contract.

6. Key Words and Phrases

Zambata.com offers no exclusivity on keywords or phrases. Each advertiser will be given ranking positions based upon the bid they enter on keywords/phrases.

7. Anti-Spam Policy

Zambata.com strictly prohibits members from sending unsolicited mass emails or spam, whether via email or any other form. Affiliates using these techniques to get traffic to their site will have their account immediately terminated.

8. Emails

In addition to adhering to the Terms described here in, Affiliates are also responsible of receiving Admin updates (and therefore keeping their mailbox clean) and manage their account accordingly. Failure to comply with requirements sent in these updates because of blocked email accounts involves the risk of loosing your account.

9. Portal pages

-We ask affiliate portals to be custom made with 100+ evenly spread keywords.

-All portal pages must be hosted on non incentive domains.

-All portal pages must have this code between <HEAD></HEAD>
<meta name="robots" content="noindex, nofollow">

-Any keyword can be write only one time.

-Category medicine (health, drugs, Pharmacy) can not be on TOP.

-BANNERs such as GOOGLE, CLICKSOR or similar are NOT PERMITTED in the middle of the portal page. We allow banners on top or on the bottom.

-We not allow keywords with regional names such as Florida, Colorado, New York, Atlanta, Chicago, London........... + other keyword. EXCEPT Las Vegas.

-We not allow keywords with WHAT and BUY.

 "Buy or what is Vicodin" is NOT ALLOWED but just "Vicodin" is! etc.

Any abuse of this will result in account cancellation.
 
10. Limitation of Liability

UNDER NO CIRCUMSTANCES WILL Zambata.com BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, FOR LOST INCOME OR PROFITS, IN ANY WAY ARISING OUT OF OR RELATED TO THIS CONTRACT, EVEN IF Zambata.com HAS BEEN ADVISED AS TO THE POSSIBILITY OF SUCH DAMAGES.

11. Copyright

All CONTENT of Zambata.com is protected under copyright law. Including but not limited to all images, HTML code, banners and logos. Anyone found infringing upon these copyright laws will be reported and could face possible criminal prosecution. Members of Zambata.com are permitted to use banner(s) and or searchbox(es) provided as is. Altering banners or searchboxes without prior approval of Zambata.com staff is strictly prohibited.

12. Change Of Terms

Zambata.com may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its members. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Affiliates continued participation in the Zambata.com program and any use of the Zambata.com Search Code property following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.
